Is our situation unique? According to the MPS report, in the United States there have been two waves of legal reforms prompted by medical malpractice claims: one in the mid-80s and another in the early 2000s. Reforms were driven by an increase in insurance premiums and concerns about access to health care. Since 2000, 29 states in the US have introduced limitations on damages; some limit both “economic” and “general” damages (compensation for pain and suffering), while others cap only general damages.
To file a certificate of merit you must first contact an expert, usually another physician. This expert will review your medical records and certify that the original health care provider deviated from accepted medical practices, which resulted in your injuries. The attorney that you hire will now file the certificate of merit, which confirms that you spoke with a medical expert and that your action has merit.

The keys are 1) establishing the medical standard of care, meaning the level of care that was appropriate under the circumstances, and 2) demonstrating how the defendant fell short of meeting that standard. And in almost all cases, you’ll need the help of a medical expert witness to help you establish these things. An experienced medical malpractice attorney will be part of a network of professionals -- doctors, consultants, medical experts who have served in a variety of cases, and other medical malpractice attorneys -- and will utilize this network to locate and hire the right medical expert for your case.

A misdiagnosis of any type of medical condition, whether it would be a disease, illness, or injury, is one of the leading causes of lawsuits related to medical malpractices. It is apparently a medical error that happens when a doctor inaccurately diagnosis a sickness, leading to a delayed, incorrect, or no treatment at all. As a result, a patient may be in a worse situation, or possibly cause an untimely death.
95. In our considered view, the aforementioned principles must be kept in view while deciding the cases of medical negligence. We should not be understood to have held that doctors can never be prosecuted for medical negligence. As long as the doctors have performed their duties and exercised an ordinary degree of professional skill and competence, they cannot be held guilty of medical negligence. It is imperative that the doctors must be able to perform their professional duties with free mind.

More and more people in South Africa are taking their doctors and other healthcare professionals to court for medical malpractice – so much so that the increase in litigation is contributing to our high medical inflation. But you can’t take such action lightly: the legal process is fraught with pitfalls and can be very drawn out, and the costs can be high. You need to be sure of your case, and of all the hoops you’ll have to jump through, before pursuing a claim.
This is really so painful to re-live. All of the attorneys I discussed my case with said that what was done to me was clearly negligence and that the case had merit indeed. However, the potential award would have fallen below the $250,000 mark, and to fight it would have been a gamble because jurors – for whatever reason – see physicians in a “can do no wrong” light and may decide in favor of the negligent doctor. I wanted to fight it out of principle more than anything else.
Deliver the demand letter to the professional in question. Either hand carry the demand letter to the professional's office or send it to him via United States mail, return receipt requested. You will need evidence to demonstrate that the demand letter was received by the professional or that you made your best efforts to deliver the letter to him.
"The opinion upholding the judgment recognizes that although not every fiduciary relationship will give rise to a claim for damages, where the specific professional responsibility of an attending physician is to convey accurate information, then failure to do so can give rise to liability if the physician's breach results in unusual and extreme emotional distress on the part of the plaintiff," Raynes said in an email.
Doctors or healthcare providers are negligent if they fail to provide the standard of care that a reasonable doctor or healthcare provider practicing in the same area would provide in similar circumstances. If the negligence causes injuries or illness to a person, then the doctor or healthcare provider may be liable to pay damages (money to pay for the harm done) to the person. It’s no excuse for a doctor to say, “I did my best. I just didn’t know any better.” If the doctor should have known better, they may be liable. For example, let’s say that you see your doctor because you are not feeling well and your doctor prescribes a drug to treat the symptoms you described. You take the drug and it harms you. It turns out that it was not appropriate, considering your medical history and the other drugs you were already taking. If other doctors with a similar practice would not have prescribed the drug, your doctor may be negligent.
Several states have sought to control increasing non-economic awards by implementing compensation caps for these types of damages. Most of these compensation caps directly address medical malpractice issues where malpractice premiums rose to a level to become disincentives for physicians to practice. The tort reform of non-economic damages was intended to ameliorate this situation and protect doctors and health facilities from exorbitant damages. However, advocates against caps argue that caps unduly penalize those victims who may require a level of damages to compensate for lifelong losses that can never be regained.

After you have done everything else, you should also meet with your doctor or the hospital officials. Even if you are not going to bring a medical malpractice case, you should try to negotiate with them one-on-one to see if they will waive some of your medical bills or compensate you in some way. You should bring an attorney with you if possible, but always remember that you should never sign any kind of legal document or waiver without an attorney looking it over first.
The most common kind of damage awards in medical malpractice lawsuits are compensatory. This is money paid for actual injury or loss. This includes medical and hospital bills, rehabilitation expenses, physical therapy, ambulance expenses, prescription drugs, nursing home care, domestic services, medical equipment, lost employment income, increased living expenses, and loss of future income. The latter is much more difficult to assess. If the doctor injured Bill Gates, the doctor will pay much more in compensation for lost earnings than if the injury was to someone who is poor or retired.
Plaintiffs can also sue for the negligent infliction of severe emotional distress that they experienced because of someone else’s injury. This types of suit occur sometimes when a person has to witness the injury or death of a loved one caused by another person’s negligence. However, to succeed on such a claim one must be able to prove that their distress was an immediate and foreseeable result of the defendant’s behavior. In addition, the plaintiff generally must physically witness the accident in order to be able to recover for this type of claim.
My Dad was an elderly, and he was killed by the misuse of an off-label medication that was contraindicative for his medical conditions. The harm was totally preventable. After Dad’s death, we talked to 20+ attorneys. 99 percent of them said there was malpractice and the doctor was negligent. But because of my Dad’s age and the lack of future earning, no attorney was willing to take my Dad’s case on contingency.

If you have been injured by a doctor, then the first step you MUST take is to request a copy of you medical records. This may be a little difficult, because some offices may try to stall or stonewall you. They will also charge you a copying fee for doing this, so be prepared. However, federal law states they must provide you with a copy of your records if you request it. These files may contain information about what went wrong with your treatment to cause the injury in question. That is why it is necessary to get a copy as soon as possible. (It should also be requested quickly after the incident because some records can be altered.) Simply contact the doctor’s office and ask for a copy of everything. This should include all notes from the doctor and other staff as well as lab work and medical imaging such as x-rays or CAT-Scans. If the incident occurred at a hospital, check with their medical records department for this information.
Generally, you must start a malpractice lawsuit within 2 years of when the malpractice occurred. This is called the limitation period. More precisely, it’s within 2 years of when a reasonable person would realize that they suffered an injury from a doctor’s actions and the court system is the right place to seek a remedy. Even if you’re well during this time, you should act quickly—while witnesses are still available and their memories are fresh. This is the general rule, but there are exceptions when the 2-year limitation period starts running at a different time. You would need to speak to a lawyer about this.
While such an idea once sounded like pure science fiction, it would present enormous opportunities in business, leisure, and medicine. Imagine, someone with a rare disease or medical condition could quickly travel anywhere in the world to obtain the best treatment option. In fact, this is already occurring, as people travel to numerous places for both medical and dental treatment. But, as we all know, sometimes medical treatment goes wrong, and this raises an interesting question. Can you sue doctors in other countries for medical malpractice?
If the medical incident that injured you occurred at a hospital, such as with a botched surgery or a post-operative infection, then you must inform the hospital as well. This will launch an internal investigation into the incident. When you contact the hospital, you should also inform them that you want to be included in the investigation. They should contact you about providing your side of the story on the record. This can also help with later litigation as the hospital may uncover evidence during this investigation.
Indeed, even the standard jury instruction does not provide the jurors with guidance in determining a figure. Abstract concepts, ambiguity and confusion are all defense tactics utilized by defense attorneys to dismantle your viable personal injury claim. This is why it becomes critical to open up to your attorney about the extent of your injuries and the complete impact that your injuries have had on your life.
Do you have skeletons in your closet? Were you less than truthful about your health and/or physical condition? Are you prepared to subject yourself to hours of questioning from attorneys, both yours and likely several others? Are you prepared to make financial disclosures that will become public? When you file a lawsuit, particularly a medical malpractice lawsuit, your life becomes a very open book -- nearly everything is fair game.
